Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of Casey Art (the “Site”) at caseyart.com.au, and your purchase of products from us. By using the Site, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refunds & Returns Policy (together, the “Policies”).

1. About our products (made-to-order)

Most items are made to order and fulfilled by our production partners via Printify. Colours, crops, and textures may vary slightly from what you see on screen. Significant print defects are covered under our Refunds & Returns Policy.

2. Pricing, currency & taxes

  • Prices are listed in Australian Dollars (AUD) and are GST-inclusive where applicable.

  • We reserve the right to change prices at any time. If a pricing error occurs, we may cancel and refund any affected order.

3. Orders & acceptance

  • Your order is an offer to buy. We may accept or decline your order at our discretion (for example, due to product availability, suspected fraud, or errors).

  • You will receive an order confirmation email when we accept your order.

​

4. Payment

  • Payments are processed securely via [Stripe / Wix Payments]. By submitting a payment method, you represent that you are authorised to use it and that the information is accurate.

  • Your card issuer may apply foreign transaction or other fees, which are your responsibility.

5. Production & shipping

  • Processing time: typically 2–5 business days for canvas prints (longer during peak periods).

  • Shipping time (AU): typically 4–8 business days once dispatched. International delivery times vary by destination and carrier.

  • Multiple items may ship separately.

6. Shipping costs & risk

  • We currently offer free standard shipping within Australia (we cover standard AU shipping up to A$20 per order; see Shipping Policy).

  • Risk in the goods passes to you on delivery at the address provided.

7. Cancellations, returns & refunds

  • Because items are made to order, change-of-mind returns aren’t accepted.

  • If your item arrives damaged, defective, not as described, or is lost in transit, we’ll replace or refund in line with the Australian Consumer Law (ACL) and our Refunds & Returns Policy.

  • You may cancel or change an order until production starts—email hello@caseyart.com.au as soon as possible.

8. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies under the ACL. Where permitted, our liability is limited to the repair, replacement, resupply, or refund of the goods.

9. Accuracy of information

We try to ensure the Site content (including product descriptions, pricing and availability) is accurate, but errors may occur. We may correct any errors and update or cancel orders affected by them.

10. Accounts (if applicable)

If you create an account, you’re responsible for maintaining confidentiality of your login and for all activity under your account. Notify us immediately of any unauthorised use.

11. Intellectual property & permitted use

  • All artworks, images, text and other content on the Site are the intellectual property of Casey Art and are protected by law.

  • Purchasing a print grants you a personal, non-commercial right to display the physical item. You may not reproduce, scan, copy, resell, or create derivative works from our artworks without written permission.

  • You may link to our Site fairly and legally, without implying any sponsorship or endorsement.

12. User content & reviews

If you submit reviews, photos or other content, you grant us a worldwide, royalty-free licence to use, reproduce and display that content in connection with the Site and our marketing (you retain your ownership). Please submit only content you own or are authorised to share, and don’t post anything unlawful or infringing.

13. Third-party services

We use third-party providers (including Wix, Printify, carriers, and Stripe/Wix Payments) to operate the Site and fulfil orders. Your use of those services may be subject to their own terms and privacy policies.

14. Promotions & discount codes

We may run promotions or offer discount codes with specific terms. Unless stated otherwise, discounts can’t be combined, don’t apply to shipping upgrades, and aren’t redeemable for cash. We may modify or withdraw promotions at any time.

15. Limitation of liability

To the maximum extent permitted by law (and subject to the ACL), we are not liable for any indirect, incidental, special or consequential loss, or loss of profit or data, arising out of or in connection with your use of the Site or the purchase or use of our products.

16. Prohibited conduct

You agree not to misuse the Site, including by attempting to gain unauthorised access, interfering with security features, scraping content, or using the Site for any unlawful purpose.

17. Privacy

We handle personal information in accordance with our Privacy Policy. By using the Site, you consent to our collection and use of your data as described there.

18. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change, and the new version applies from the date it is posted.

19. Governing law

These Terms are governed by the laws of South Australia, Australia, and the courts of South Australia have non-exclusive jurisdiction.
